The great news is that if you apply for a D4 Visa and are going to study in Portugal, your family can also go.
However, it is necessary to initially pay attention to who is considered a family member for the purposes of family reunification of the holder of a Residence Permit for study.
The family members are the following:
- - The spouse
- - Minor or incapacitated children in the care of the couple or one of the spouses
- - Minors adopted by the applicant when he or she is not married, by the applicant or by the spouse, as a result of a decision by the competent authority of the country of origin, provided that the law of that country recognises the rights and duties of the adopted children identical to those of natural filiation and that the decision is recognised by Portugal
In addition, stable unions, called de facto unions in Portugal, are also recognized. Therefore, family reunification can also be authorized for:
- - The partner who maintains, in national territory or abroad, with the resident foreign citizen a de facto union, duly proven under the terms of the law
- - Unmarried minor or incapacitated children, including children adopted by the de facto partner, provided that they are legally entrusted to the partner.
This way, after obtaining the Student Visa for Portugal and processing the residence permit with the SEF, you will be able to process family reunification. Family members will also receive a residence permit, as will the student, for the same period of validity.
